Terms of Service

1. Agreement

By creating an account or using Safety Signal (the "Service"), you agree to these Terms on behalf of yourself and the company you represent. If you do not agree, do not use the Service. Safety Signal is operated by Morgan Software LLC ("we," "us," or "Safety Signal").

2. The Service

Safety Signal provides a platform for construction and industrial companies to access incident data, generate AI-powered safety briefings, log workplace incidents, track certifications, and produce OSHA-ready documentation. We reserve the right to modify or discontinue any part of the Service with reasonable notice.

3. Accounts and Companies

You must be 18 or older to create an account. One account creates one company workspace. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at hello@safety-signal.com if you suspect unauthorized access.

4. Your Data — Ownership and License

You own your data. Incident reports, observations, training records, certifications, photos, and any other content your team submits ("Company Data") remain your property. We do not claim ownership of Company Data.

By using the Service, you grant Safety Signal a limited, non-exclusive, worldwide, royalty-free license to:

• Store, process, and display Company Data to provide the Service to you and your team members;
• Use anonymized and aggregated data — stripped of company name, employee names, site locations, and any other identifying information — to improve Safety Signal's AI models, product features, and cross-company safety insights.

We will never:

• Sell your raw Company Data to any third party;
• Share identifiable Company Data with any other company without your explicit written consent;
• Use your incident photos for any purpose other than displaying them within your account.

Anonymized, aggregated insights derived from Company Data (for example, industry-level trend analysis) may appear in product features, reports, or marketing without attribution to you.

5. OSHA Data

The incident database included in Safety Signal is sourced from the OSHA Injury Tracking Application (ITA), a public government dataset. This data is provided for informational and training purposes only and does not constitute legal advice. Safety Signal makes no warranty about the completeness or accuracy of OSHA ITA data.

6. Subscriptions and Payment

Paid plans are billed through Stripe. Subscription fees are charged at the start of each billing period and are non-refundable except as required by law or at our sole discretion. A one-time onboarding fee may apply to new subscriptions. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose;
• Submit false or fabricated incident reports;
• Attempt to access another company's data;
• Reverse-engineer, scrape, or resell any part of the Service or its underlying data;
• Use the AI-generated briefings as a substitute for qualified safety professional advice.

8. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. Safety Signal does not warrant that AI-generated briefings are legally compliant, complete, or suitable for your specific worksite conditions. Always consult a qualified safety professional for regulatory compliance. We are not responsible for any workplace incident, injury, or citation that occurs regardless of your use of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Morgan Software LLC's total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the three months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages.

10. Termination

You may cancel your account at any time from the Settings screen. We may suspend or terminate accounts that violate these Terms. Upon termination, we will retain your Company Data for 30 days during which you may request an export, after which it will be permanently deleted.

11. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Louisiana.

12. Changes

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
